2. Allgemeine Hinweise zur Datenverarbeitung
Wir erheben und verwenden personenbezogene Daten unserer Teilnehmer grundsätzlich nur, soweit dies zur Bereitstellung unserer Angebote und Leistungen erforderlich ist. Bild- und Videoaufnahmen aus den Sessions werden mit gesonderter, freiwilliger Einwilligung des Teilnehmers veröffentlicht und zu Marketingzwecken verwendet.
3. Erhobene Datenkategorien
Im Rahmen unserer Geschäftstätigkeit verarbeiten wir folgende Kategorien personenbezogener Daten:
- Stammdaten: Name, Vorname, Adresse;
- Kommunikationsdaten: Telefonnummer, E-Mail-Adresse;
- Zahlungsdaten: PayPal-Account;
- Bild- und Videomaterial: Fotos und Videos, die im Rahmen unserer Sessions entstehen, nur mit Ihrer ausdrücklichen und freiwilligen Einwilligung;
- Gesundheitsangaben, die für die Trainingsteilnahme relevant sind, nur mündlich und freiwillig.
4. Zwecke und Rechtsgrundlagen der Verarbeitung
4.1 Teilnehmerverwaltung und Vertragsdurchführung
Die Verarbeitung Ihrer Stamm- und Kontaktdaten erfolgt zur Begründung, Durchführung und Beendigung der Teihname- bzw. Vertragsverhältnisses (Art. 6 Abs. 1 lit. b DSGVO).
4.2 Buchungssystem (BookingPress)
Zur Verwaltung von Sessions-Buchungen setzen wir den Dienst BookingPress (Repute InfoSystems, 705-706, Twinstar North Tower 150ft Ring Road, Rajkot 360005, Gujarat, India) ein. Bei der Buchung werden Name, Kontaktdaten sowie die gebuchten Leistungen erfasst. Die Verarbeitung dient der Vertragserfüllung gemäß Art. 6 Abs. 1 lit. b DSGVO. BookingPress verarbeitet Daten im Rahmen einer Auftragsverarbeitung nach Art. 28 DSGVO. Im Rahmen der Nutzung der BookingPress-Diensten kann es zu einer Übermittlung personenbezogener Daten an Server außerhalb der Europäischen Union, insbesondere in die USA und Indien kommen. Die Datenübermittlung erfolgt auf Grundlage geeigneter Garantien gemäß Art. 46 DSGVO, insbesondere Standardvertragsklauseln der EU-Kommission. 4.3 Kommunikation per WhatsApp Business oder E-Mail
Für die direkte Kommunikation mit Teilnehmern und Interessenten nutzen wir WhatsApp Business. Sofern Sie uns über diesen Kanal kontaktieren, werden die von Ihnen übermittelten Daten (insbesondere Name und Nachrichteninhalt) zur Bearbeitung Ihrer Anfrage verwendet. Rechtsgrundlage ist Art. 6 Abs. 1 lit. b bzw. lit.f DSGVO. Wir weisen darauf hin, dass WhatsApp Business von WhatsApp Ireland Limited (4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Irland) betrieben wird. Es kann hierbei zu einer Übermittlung personenbezogener Daten an Server der Meta-Unternehmen in den USA kommen. Wenn Sie uns per E-Mail kontaktieren, verarbeiten wir Ihre Angaben zur Bearbeitung Ihrer Anfrage. Wir nutzen für E-Mails den Dienst Gmail der Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland. Eine Übermittlung an Google LLC in den USA ist möglich, Grundlage sind das EU-US Data Privacy Framework und Standardvertragsklauseln. 4.4 Zahlungsabwicklung
Entscheiden Sie sich für die Zahlung per PayPal, werden Ihre Zahlungsdaten an PayPal Europe (S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg) übermittelt. Die Verarbeitung erfolgt auf Grundlage von Art. 6 Abs. 1 lit. b DSGVO (Vertragserfüllung). Eine Übermittlung personenbezogener Daten an Unternehmen von PayPal in Drittländern, insbesondere in die USA, kann nicht ausgeschlossen werden. Die Datenübermittlung erfolgt auf Grundlage des EU-US Data Privacy Frameworks sowie geeigneter Garantien gemäß Art. 46 DSGVO. 4.5 Webhosting (IONOS)
Unsere Website wird bei der 1&1 IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, gehostet. Mit IONOS besteht ein Auftragsverarbeitungsvertrag nach Art. 28 DSGVO. Beim Aufruf der Website werden automatisch Daten gemäß Art. 6 Abs. 1 lit. f DSGVO in Server-Logfiles erfasst (IP-Adresse, Datum, Uhrzeit, aufgerufene Seite, Browsertyp). Das ist für den sicheren und stabilen Betrieb der Website erforderlich. Die Logfiles werden nach 7 Tagen gelöscht. Die Website ist TLS-verschlüsselt. Die Server stehen in der EU.
Einwilligungsabhängige Dienste (Webanalyse) werden gemäß § 25 Abs. 1 TDDDG / Art. 6 Abs. 1 lit. erst nach Ihrer Einwilligung über das Cookie-Banner aktiviert. 4.6 Foto- und Videoveröffentlichungen / Social Media
Bei Club-Aktivitäten fertigen wir Foto- und Videoaufnahmen an. Wir veröffentlichen Aufnahmen, auf denen Sie erkennbar sind, nur mit Ihrer ausdrücklichen und freiwilligen Einwilligung gemäß Art. 6 Abs. 1 lit. a DSGVO, § 22 KUG. Die Einwilligung ist freiwillig und kann gesondert in Textform erteilt werden. Hierzu erhält der Teilnehmende nach der Buchung eine entsprechende Anfrage. Ihre Teilnahme an unseren Sessions ist auch ohne Einwilligung möglich. Dann achten wir darauf, dass Sie nicht erkennbar abgebildet werden.
Sie können die Einwilligung jederzeit ohne Angabe von Gründen mit Wirkung für die Zukunft widerrufen, formlos per E-Mail an y.lobo.ssc@gmail.com. Wir entfernen die betroffenen Aufnahmen dann von unseren Kanälen, soweit uns das möglich ist. Bereits an Dritte weitergegebene oder von Dritten geteilte Inhalte können wir nicht in jedem Fall zurückholen.
Veröffentlichung erfolgt im WhatsApp-Status, sowie auf Instagram und Facebook, die eigenen Datenschutzbestimmungen unterliegen. Im Rahmen der Nutzung der Meta Platformen kann es zu einer Verarbeitung personenbezogener Daten durch Meta sowie zu einer Übermittlung von Daten an Server der Meta Platforms Inc. in den USA kommen. 4.7 Verlinkungen zu Social-Media-Profilen
Auf unserer Website befinden sich Verlinkungen zu unseren Profilen auf Instagram (instagram.com) und Facebook (facebook.com). Beim Klick auf diese Links verlassen Sie unsere Website und werden direkt zur jeweiligen Plattform weitergeleitet. Eine Datenübertragung an Meta findet erst durch das aktive Anklicken des Links statt. 4.8 Gesundheitsangaben
Sie teilen uns freiwillig gesundheitliche Einschränkungen mit, die für die Teilnahme an jeweiligen Sessions relevant sind. Diese Angaben verwenden wir ausschließlich, um die Sessions sicher auf Ihre Belastbarkeit abzustimmen. Wir speichern sie nicht und geben sie nicht weiter.
5. Weitergabe von Daten an Dritte
Ihre personenbezogenen Daten werden an folgende Empfänger übermittelt:
- Dienstleister im Rahmen einer Auftragsverarbeitung (BookingPress für die Buchungsverwaltung; IONOS für das Webhosting und Webanalyse);
- Zahlungsdienstleister (PayPal), sofern Sie diese Zahlungsmethode wählen;
- Social-Media-Platform-Anbieter (Meta), sofern eine entsprechende Einwilligung erteilt wurde;
- Wenn wir gesetzlich zur Weitergabe verpflichtet sind.
6. Speicherdauer
Wir speichern Ihre Daten nur so lange, wie es für den jeweiligen Zweck erforderlich ist:
- Buchungs- und Vertragsdaten sowie Zahlungsbelege: 8 Jahre ab Ende des Kalenderjahres, in dem sie entstanden sind, gemäß steuer- und handelsrechtlichen Aufbewahrungspflichten.
- Geschäftliche E-Mails und WhatsApp-Nachrichten mit Vertragsbezug: 6 Jahre, sonst Löschung, sobald Ihre Anfrage erledigt ist.
- Anfragen ohne Vertragsschluss: Löschung spätestens 12 Monate nach Abschluss der Anfrage.
- Foto- und Videoaufnahmen: bis zum Widerruf Ihrer Einwilligung, längstens 3 Jahre nach Aufnahme.
- Server-Logfiles, und bei Ihrer Einwilligung Webanalyse-Daten: siehe 4.5.
Nach Ablauf der Fristen werden die Daten gelöscht oder gesperrt.
7. Ihre Rechte als betroffene Person
Gemäß der DSGVO stehen Ihnen folgende Rechte zu:
- Auskunftsrecht (Art. 15 DSGVO): Sie können Auskunft über die zu Ihrer Person gespeicherten Daten verlangen.
- Berichtigungsrecht (Art. 16 DSGVO): Sie können die Berichtigung unrichtiger oder unvollständiger Daten verlangen.
- Löschungsrecht (Art. 17 DSGVO): Sie können unter bestimmten Voraussetzungen die Löschung Ihrer Daten verlangen.
- Recht auf Einschränkung der Verarbeitung (Art. 18 DSGVO): Sie können die Einschränkung der Verarbeitung Ihrer Daten verlangen.
- Recht auf Datenübertragbarkeit (Art. 20 DSGVO): Sie können verlangen, dass wir Ihnen Ihre Daten in einem strukturierten, gängigen und maschinenlesbaren Format zur Verfügung stellen.
- Widerspruchsrecht (Art. 21 DSGVO): Sie können der Verarbeitung Ihrer Daten widersprechen, sofern diese auf berechtigten Interessen beruht.
- Widerrufsrecht: Eine erteilte Einwilligung können Sie jederzeit ohne Angabe von Gründen mit Wirkung für die Zukunft widerrufen.

Wir treffen technische und organisatorische Maßnahmen, um Ihre personenbezogenen Daten gegen zufällige oder vorsätzliche Manipulation, Verlust, Zerstörung oder den Zugriff unberechtigter Personen zu schützen. As a rule, we collect and use the personal data of our participants only to the extent necessary for providing our services and offers. Photos and videos from Sessions are published and used for marketing purposes only with the participant’s separate and voluntary consent.
3. Categories of Data Collected
As part of our business activities, we process the following categories of personal data:
- Master data: first name, last name, address;
- Contact data: telephone number, email address;
- Payment data: PayPal account;
- Photo and video material: photos and videos taken during our Sessions, only with your express and voluntary consent;
- Health information relevant to participation in training, provided verbally and voluntarily only
4. Purposes and Legal Bases for Processing
4.1 Participant Management and Contract Performance
Your master data and contact details are processed for the establishment, performance, and termination of participation and contractual relationships (Art. 6 para. 1 lit. b GDPR).
4.2 Booking System (BookingPress)
We use the BookingPress service (Repute InfoSystems, 705-706, Twinstar North Tower, 150ft Ring Road, Rajkot 360005, Gujarat, India) to manage Session bookings. When making a booking, your name, contact details, and the booked services are recorded. The processing is carried out for the performance of a contract pursuant to Art. 6 para. 1 lit. b GDPR. BookingPress processes data on our behalf in accordance with Art. 28 GDPR. As part of using BookingPress services, personal data may be transferred to servers outside the European Union, particularly in the United States and India. Such transfers are carried out on the basis of appropriate safeguards pursuant to Art. 46 GDPR, in particular the EU Commission’s Standard Contractual Clauses. 4.3 Communication via WhatsApp Business or Email
For direct communication with participants and interested persons, we use WhatsApp Business.
If you contact us through this channel, the data you provide (in particular your name and message content) will be used to process your request. The legal basis is Art. 6 para. 1 lit. b and/or lit. f GDPR. Please note that WhatsApp Business is operated by WhatsApp Ireland Limited (4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland). Personal data may be transferred to servers of Meta companies in the United States. Such transfers are based on the EU-US Data Privacy Framework and the EU Commission’s Standard Contractual Clauses. 4.4 Payment Processing
If you choose payment via PayPal, your payment data will be transmitted to PayPal Europe (S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg). Processing is carried out on the basis of Art. 6 para. 1 lit. b GDPR (contract performance). The transfer of personal data to PayPal companies in third countries, particularly the United States, cannot be excluded. 4.5 Web Hosting (IONOS)
Our website is hosted by 1&1 IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany. A data processing agreement pursuant to Art. 28 GDPR has been concluded with IONOS. When visiting the website, data is automatically collected and stored in server log files in accordance with Art. 6 para. 1 lit. f GDPR (IP address, date, time, accessed page, browser type). This is necessary to ensure the secure and stable operation of the website. The log files are deleted after 7 days. The website is protected by TLS encryption. The servers are located within the EU.
Consent-based services (web analytics) are activated only after your consent via the cookie banner in accordance with Section 25 para. 1 TDDDG / Art. 6 para. 1 GDPR. 4.6 Publication of Photos and Videos / Social Media
During club activities, we take photos and videos. We publish recordings in which you are identifiable only with your express and voluntary consent pursuant to Art. 6 para. 1 lit. a GDPR and Section 22 German Art Copyright Act (KUG). The consent is voluntary and may be provided separately in text form. For this purpose, the participant will receive a corresponding request after completing the booking. Participation in our Sessions is also possible without providing consent. In that case, we will ensure that you are not recognizably depicted.
You may withdraw your consent at any time without stating reasons, with effect for the future, by sending an email to y.lobo.ssc@gmail.com. We will then remove the respective recordings from our channels to the extent possible. Content already shared with third parties or re-shared by third parties may not always be retrievable.
Publications may appear in WhatsApp Status as well as on Instagram and Facebook, which are subject to their own privacy policies. When using Meta platforms, personal data may be processed by Meta and transferred to servers of Meta Platforms Inc. in the United States. Such transfers are based on the EU-US Data Privacy Framework and the Standard Contractual Clauses approved by the European Commission. 4.7 Links to Social Media Profiles

4.8 Health Information
You may voluntarily inform us about health limitations that are relevant to your participation in the respective Sessions. We use this information exclusively to adapt the Sessions safely to your physical capabilities. We do not store this information and do not share it with third parties
5. Disclosure of Data to Third Parties
Your personal data may be transferred to the following recipients:
- Service providers acting as data processors (BookingPress for booking management; IONOS for web hosting and web analytics);
- Payment service providers (PayPal), if you choose this payment method;
- Social media platform providers (Meta), provided that the participant has given the corresponding consent;
- Authorities or other recipients where we are legally obliged to disclose data.
6. Data Retention Period
We store your data only for as long as necessary for the respective purpose:
- Booking and contract data as well as payment records: 8 years from the end of the calendar year in which they were created, in accordance with tax and commercial record retention obligations.
- Business emails and WhatsApp messages related to contractual matters: 6 years; otherwise deleted as soon as your inquiry has been resolved.
- Inquiries that do not result in a contract: deletion no later than 12 months after completion of the inquiry.
- Photos and videos: until you withdraw your consent, but no longer than 3 years after recording.
- Server log files and, where consent has been given, web analytics data: see Section 4.5.
After the retention periods have expired, the data will be deleted or blocked.
7. Your Rights as a Data Subject
Under the GDPR, you have the following rights:
- Right of access (Art. 15 GDPR): You may request information about the personal data stored about you.
- Right to rectification (Art. 16 GDPR): You may request the correction of inaccurate or incomplete data.
- Right to erasure (Art. 17 GDPR): Under certain circumstances, you may request the deletion of your personal data.
- Right to restriction of processing (Art. 18 GDPR): You may request the restriction of the processing of your data.
